If you wish to request a refund for any reason, including if the products are unsatisfactory or for any other reason, please contact the restaurant where you purchased the product regarding any refund owed to you. Ownership and License of Online Services</h4><br> McDonald’s Intellectual Property Rights. All rights to any and all online services are and remain the property of McDonald’s or its licensors. For clarity, “online services” include all content contained within the online services, including, but not limited to, text, images, graphics, logos, headers, button icons, images, audio clips, digital downloads, data compilations, software, trademarks, service marks, trade names, audio, video, data, and other materials (collectively referred to as “the Content”), as well as any part of the Online Services. The Online Services are licensed to you, not sold. No provision of these Terms is intended to transfer or assign any of these rights to you. You may not take any action intended to compromise, limit, or affect the rights of McDonald’s or its licensors. <br> Your License to Use the Online Services. Subject to these Terms, you are granted a personal, non- exclusive, non-transferable, and revocable license to use the Online Services solely for your personal, non-commercial use, in accordance with these Terms. For clarity, the term “use” includes accessing, interacting with, and displaying. No license or right is granted to you by implication or otherwise, except for the licenses and rights expressly granted to you in these Terms. McDonald’s Corporation reserves all other rights. <br> Trademark Information. Trademarks, service marks, and all graphic elements—including the presentation and functionality of the content of the online services—are distinctive and protected trademarks and trade names of McDonald’s or its licensors. The online services may also include various names, trademarks, and service marks of third-party companies, which are the property of their respective owners. <br><br> <h4>5. Acceptable Uses and Restrictions on Online Services</h4><br> Acceptable Uses and Other Restrictions. Limitations of Liability and Disclaimers</h4><br> Limitations on McDonald’s Liability. McDonald’s Morocco shall not be liable for any direct or indirect damages resulting from lost profits or lost business opportunities, nor for any special, indirect, incidental, consequential, or punitive damages, including data loss, personal injury, or property damage related to or arising from the online services. This section is not intended to limit McDonald’s liability for damages caused by McDonald’s own gross negligence or intentional or unlawful conduct. Furthermore, this section is not intended to limit or affect your consumer rights that cannot be limited or affected under applicable law. McDonald’s Morocco reserves all rights to seek relief or damages under these terms or as permitted by law. <br> McDonald’s Morocco provides the online services “as is” and without any warranty. The online services may contain inaccuracies or errors. McDonald’s Morocco provides the online services “as is” and without any warranty of any kind, whether express or implied. McDonald’s Morocco disclaims any warranty regarding the merchantability of the online services or their fitness for a particular purpose. McDonald’s Morocco makes no warranty or representation that the online services are accurate, reliable, uninterrupted, or error-free; that any defects in them will be corrected; or that the online services are free of viruses or other harmful components. You assume full responsibility for your use of the online services. Your sole and exclusive remedy against McDonald’s Morocco and all other members of the McDonald’s system based on your dissatisfaction with the online services is to stop using them. This limitation of liability is an element of the negotiation between the parties. <br> Third-Party Services. The online services may link to or allow you to use third-party websites, downloadable materials, content, social media platforms, or other digital services (collectively referred to as “third-party services”). These third parties may have their own privacy policies or terms of use, which you should review and understand before using them. McDonald’s Morocco neither endorses nor is affiliated with any of these third-party services. McDonald’s Morocco and all members of the McDonald’s system shall not be held liable for any loss or damage arising from or related to these third-party services. <br> Events Beyond Our Control. McDonald’s Morocco and all members of the McDonald’s system shall not be liable for any failure to perform their obligations under these Terms caused by or otherwise associated with any event beyond their reasonable control. If such an event occurs, McDonald’s Morocco’s obligations under these terms will be suspended for the duration of the event, and McDonald’s Morocco may, but is not obligated to, use any reasonable means to find a solution so that its obligations under these terms may be fulfilled despite the event in question. <br><br> <h4>7. Apple Apps</h4><br> These Terms incorporate and supplement the terms and conditions of use of Apple Inc. (“Apple”) (available at http://www.apple.com/legal/itunes/us/terms.html#service), including the End User License Agreement for the application hereinafter referred to as the “Apple Application.” If you use the online services through an Apple application (“Apple Application”), you also acknowledge and agree that: - Apple has no obligation of any kind to provide any maintenance or support services for the Apple App. If you have any questions regarding the maintenance or support of Apple Apps, please contact McDonald’s Morocco, not Apple, using the support service details provided herein. - Unless expressly provided otherwise in these terms, any dispute arising in any way from the possession or use of the Apple Apps is between you and McDonald’s Morocco (and not between you, or any other person, and Apple). And, - In the event of a claim by a third party alleging that your possession or use (in accordance with these terms) of the Apple App constitutes an infringement of any intellectual property right, Apple shall not be liable to you in connection with such claim. If the Apple App you purchased does not conform to any applicable warranty, you may notify Apple, which may then refund the purchase price of said Apple App, subject to Apple’s then-current Terms of Use. In such a case, and to the fullest extent permitted by law, Apple does not offer, nor is it part of, any warranty, condition, or other provision relating to the Apple App, and will not be liable to you for any claim, loss, cost, or expense of any kind in connection with the Apple app or arising from your use of the Apple app, the use of the Apple app by anyone else, or reliance on its content. <br><br> <h4>8. Miscellaneous</h4><br> McDonald’s Morocco makes no representation that the online services are appropriate or available outside of Morocco. If you access the online services from other locations, you are solely responsible for complying with applicable local laws. <br> These Terms of Use shall be governed by and construed in accordance with the laws of Morocco, without regard to any conflict of laws principles. You irrevocably consent, for the purposes of any legal action arising out of or related to these Terms or the online services, that the exclusive jurisdiction shall be the competent Moroccan court of your domicile or residence in Morocco.<br> - Although these Terms govern the online services solely between McDonald’s and you (and although Apple is not a party to these Terms, nor is any other member of the McDonald’s system), Apple and the other members of the McDonald’s system are third-party beneficiaries under these Terms. As such, they have the right to enforce against you the rights that McDonald’s holds under these Terms, to the extent that these Terms apply to them. There are no other third-party beneficiaries under these Terms. <br> - These terms and conditions have been drafted in French. <br> - Upon termination of these Terms or of the permission granted to you to use the online services, all rights granted to you under these Terms will expire. However, these Terms will continue to apply to your prior use of the online services and any matters related to or arising therefrom. After termination, all rights of McDonald’s Morocco and all members of the McDonald’s system, including all intellectual property rights, exclusivity rights, and licenses, as well as all usage restrictions, limitations of liability, and disclaimers, will continue to apply. <br> - All terms and provisions set forth in these Terms are severable and apply individually. If any of them is illegal, void, or unenforceable, the remainder of these Terms shall remain in full force and effect. <br> - If McDonald’s Morocco does not insist that you fulfill your obligations under these terms, or if McDonald’s Morocco does not exercise its rights against you or does so after a certain period of time, this shall in no way imply that McDonald’s Morocco has waived its rights against you or that you are not required to comply with your obligations. <br> - McDonald’s Morocco may transfer its rights and obligations under these Terms to another entity or organization, but this shall not affect your rights or obligations under these Terms in any way. You may not transfer your rights or obligations under these Terms to another person unless McDonald’s Morocco consents in writing.
